Memorial Deed 202

To the Registrar appointed by Act of Parliament for registering Deeds Wills
and so forth in Ireland.

A Memorial of an Indenture of Assignment made the fifth day of April year of
our Lord with one thousand eight hundred and sixty seven Between John
RUSSELL of the City of Cork Merchant of the first part John Augustine IEVERS
of Quintan Street in the City of Limerick Esquire J.P. and Eliza IEVERS his
wife of the second part William Lane JOYNT Esquire D.L., J.P. Lord Mayor of
the City of Dublin of Dawson Street in the City of Dublin of the third part
and Eyre POWELL of Number Five Newenham Street in the County of the City of
Limerick Esquire and Robert HUNT Esquire of George street Limerick in the
County of County [sic] of Limerick of the fourth part after reciting a
certain Indenture of assignment by way of mortgage bearing date on or about
the seventeenth day of October one thousand eight hundred and fifty nine and
further reciting as therein said Indenture of which this writing is a
memorial witnessed that in pursuance of the agreement and for the
considerations therein mentioned He the said John RUSSELL did by said
Indenture assign unto the said Eyre POWELL and Robert HUNT their and each of
their executors administrators and assigns all and singular the sum or
charge of Five hundred pounds of the late Irish Currency charged upon the
lands of Ballyavilla otherwise Mount Ievers Bally Brehane Fortwilliam
Ballyliddane West Ballyliddane East Bunelagh otherwise Heathmount and
Ieverstown within the subdenominations in the Barony of Bunratty and the
lands of Carrowmore and Mongboy in the Barony of Tulla and all within County
of Clare and all the Estate and Interest of the said John RUSSELL in or to
the said sum or charge of Five hundred pounds thereby granted and assigned
and in or to every or any part thereof by virtue of the therein before in
part recited Indenture of Mortgage of the Seventeenth day of October one
thousand eight hundred and fifty nine and all other the Deeds evidences and
writings then in the Custody or power of him the said John RUSSELL as such
Mortgaged as aforesaid relating to the said sum or charge of Five hundred
pounds or any part thereof To hold the same unto the said Eyre POWELL and
Robert HUNT their and each of their executors administrators and assigns as
therein mentioned and which said Indenture contained a declaration and
agreement by and between the parties thereto that the said Eyre POWELL and
Robert HUNT should stand possession of the said sum or charge of Five
hundred pounds and other the premises thereby assigned in trust for the sole
use and behoof of the said John Augustine IEVERS and Eliza IEVERS his wife
which said Deed  as to the execution thereof by the is witnessed by Andrew
BENNETT by the said John RUSSELL saw this memorial thereof as to its due
perfection same is witnessed by Andrew BENNETT of No 9 Connell street in the
County of the City of Cork and Benjamin BENNETT of No 9 Connell street in
the County of the City of Cork both accountants.

Now I the above named Andrew BENNETT Make oath and say that I am a
subscribing witness to the execution of the Deed of which the foregoing
writing is a memorial and also to the said memorial. I was present and saw
said Deed duly signed sealed and delivered by said John RUSSELL and
executing party thereto and that the name Andrew BENNETT  subscribed  as a
witness to the execution of said Deed and Memorial respectively is my proper
name and handwriting.
Sworn by me this fifth day of April 1867 at the Cork Hall Cork in the County
of the City of Cork by a Master Extraordinary of Her Majesty's High Court of
Chancery in Ireland for taking affidavits for said Court in and for said
County and City and I know the Deponent. (signed) [Cannot read-Andrew
