To the Register Appointed for Registering of the Deeds (blurred writing) of
Dublin-As Memorial of an
Indenture bearing date the Eleventh day of February in the year One
thousand Eight hundred and Five Made Between James Joynt of Hollymount in the
County of Galway Gent of the one part and Richard Galbreath of Capard in the
said County of Galway Esqr of the Other part whereby after reciting that by
Indenture of Lease bearing date the Twenty sixth day of March in the Year One
thousand Seven hundred and Eighty two and made between James Galbreath of Capard
in the said County of Galway Esqr and the said James Joynt of the other part, He
the said James Galbreath for the Consideration therein mentioned did demise
grant, let and to farm let Release and Confer on unto the said James Joynt in
his possession being the Farm and Lands therein and herein after particularly
mentioned To hold the same unto the said James Joynt his heirs and Assigns from
the day (next?) before the date thereof for and during the natural Lives therein
mentioned. He the said James Joynt yielding and paying the rent therein also
particularly mentioned, and fturther reciting that by an Indenture of Lease
bearing date of the Eleventh day of Nov in the year One thousand seven hundred
and ninety three, and made between Andrew Galbreath of Capard in the said County
of Galway Esqr and the said James Joynt of the other part. He the said Andrew
did demise and let unto the said James Joynt the lands therein and herein after
particularly mentioned. To hold the same unto the said James Joynt his Executors
Administrators and Assigns for the lives therein particularly mentioned yielding
and paying the rent therein mentioned, and further reciting that the said
Richard Galbreath hath agreed to and with the said James Joynt for the purchase
of all his Estate Right Title and Interest and Term yet to come and (???) of and
in the premises by virtue of the said Indentures for the Sum of One thousand
four hundred pounds by which said Deed of which this is a Memorial the said
James Joynt for and in Consideration of the said Sum of One Thousand four
hundred pounds-to him paid by the said Richard Galbreath before the Sealing and
delivery of the said Deed the said James Joynt doth hereby acknowledge Granted
Bargained Sold Released and confirmed unto the said Richard Galbreath his heirs
Executors Administrators and Assigns All that and those the said Farm Town and
Lands of Driminagoule (& Fernane?) with the Mountain thereunto belonging
situate lying and being in the half Barony of Loughrea and County of Galway
aforesaid being the lands and premises mentioned in the first recited Indenture,
and also all that and those the said Lands Commonly Called (Currocathand?) and
the Lands South and east of the Road in as large and ample Manner as he the said
James Joynt then held the same situate lying and being in the half Barony of
Loughrea in the said County of Galway being the Lands in the said last recited
Indenture mentioned and all the Estate rights Title Interest Term of Lives yet
to come and unexpired claim and demand of him the said James Joynt of in and to
the Same or any part thereof together with the said Two Recited Indentures of
Lease, To hold the Same unto the said Richard Galbreath his heirs Executors
Administrators and Assigns for and during all the rest Residue and Remainder yet
to come and unexpired of the said Term for lives in and by the said Indentures
of Lease granted in as full large and ample manner to all Intents and Purposes
as he the said James Joynt his heirs Executors Administrators or assigns might
should or
ought to have hold or Enjoy the Same by virtue of the said two recited
Indentures of Lease or otherwise which said deed of Assignment (blurred) this
Memorial thereof (???) severally Executed by the said James Joynt and are
witnessed by Robert O’Hara of (Rakeen?) in the said County of Galway Esqr and
by James Joynt
The above named Robert O'Hara maketh oath that he is a Subscribing witness to
the Deed of Assignment which the above is a Memorial and that he is also a
subscribing witness to the above Memorial and he Saw the said deed signed sealed
and duly executed by the said James Joynt and Richard Galbreath and that he also
saw severally subscribed as a witness to this Deed and to this memorial is this
deponents name and proper handwriting and that he delivered the same to John
Griffin Gent -by Right or near half after One on this 10 day of Feby 1805
