Memorial
To the Register Appointed by act of Parliament for the
Publick Registry of Deeds Will conveyances and so forth
A Memorial of an Indented ddded of Marriage Settlement bearing date the Fourth
day of July in the year of our Lord one Thousand eight hundred and Nine and made
Between Jane Fraser of the town of Kinsale widow and administrative of the Late
James Fraser of (Covebille?) in the county of Cork deceased and Jane Fraser of
the town of Munster eldest Daughter unmarried of the said Jane Fraser of the
first part Richard Joynte Esqr Lieutenant in the Roscommon Regiment of Militia
now Stationed in Kinsale in said County of the second part and William Killock
of the City of Cork Esq and Merchant and Anthony Lennon Esqr Lieutenant in said
regiment of the three part Reciting that a Marriage by Gods Permission was
shortly to be had and Solemnized between the said Richard Joynte and the said
Jane Fraser the younger whereby the said Richard Joynte did for the
Consideration of the sum of Four hundred Pounds convey the Marriage Portion of
the said Jane Fraser the Receipt which is by said deed acknowledged and also for
the further consideration the sum of five shillings to him in hand paid by the
said William Killock and Anthony Lennon the receipt thereof is also by said deed
acknowledged did grant,assign and convey unto them the said William Killock and
Anthony Lennon their Heirs and Assigns All That and Those (???) undivided Morety
thence and proportion of and in the Farm and Lands of Kilmore and Abbey which he
the said Richard Joynte is now absolutely unletted unto by and under the Will of
his Father James Joynte late of Loughrea in the County of Galway Esqr deceased
and which said Premises are situate lying and being in the Barony of (??) and
County of Galway aforesaid To Hold same unto them the said William Killock and
Anthony Lennon their Heirs and Assigns for and during the Natural Life of
Charles Annesley of Ballysax in the County of Kildare Esqr and (???) one years
in (???????) to permit and Suffer (??)said Richard Joynte and his Assigns to
Recur and take to his own proper use and (behoove? the issues?) and Profits
thereof during his Natural Life And upon the further trust intent and Purpose
that in case the said Jane Fraser should after the said Intended Marriage happen
to divorce him the said Richard Joynte her Intended husband that she the said
Jane Fraser the younger would have and receive of only and every year during the
term of her Natural Life provided she should not inherit (so long between?)
Continue of in and to said undivided Morety have receive and take to his own
sole undue Benefit one Annuity clearly (???) but Charge a sum of Sixty Pounds a
year to be yearly (???ing and ???ing) and payable out of Undivided Morety of
said Lands and premises to be paid and payable by (??) even and equal half
yearly Payments in the year that is to say on every first day of February and
every first day of November the first payment thereof to begin and to be made on
either of said days which should first happen after the decease of the said
Richard Joynte and in order to further secure the indenture and Maintenance of
the said Jane Fraser the said Richard Joynte hath also paper (his Br??? in the
Warrant of Abbey?) for confering Judgment thereon unto them the said William
Killock and Anthony Lennon for the sum of one thousand pounds the trust that in
case she the said Jane Fraser should survive the said Richard Joynte and the
(execution?) of the said lease that therein as such case she was to have and
receive the Interest and Produce ??? the her Natural Life Witness to the
Execution of the said Indented Deed and to this Memorial are (Corriegan Levin?)
Lieutenant in His Majesty's Roscommon Regiment of Militia and William Daly of
the Town of Kinsale Gentleman Attorney at Law.
The above named William Daly maketh Oath and Saith that he this deponent whereof
the above Writing is a Memorial duly executed by the said Jane Fraser Jane
Fraser the younger Richard Joynte William Killock and Anthony Lennon and that he
saw the said Richard Joynte duly execute this memorial and that the name William
Daly subscribed as Witness to the deponents proper name and handwriting.
